This dissertation argues that literary writers and cultural critics, such as Luis Valdez and Toni Morrison, share an intellectual space with legal scholars of color, such as Patricia Williams and Richard Delgado. Applying theoretical concepts from postcolonial theory such as hybridity, catachresis, and the subaltern, this dissertation concludes that these seemingly disparate writers have developed a complex, theoretical critique of social, cultural, and legal relations articulated through poststructural writing practices in response to the successes and failures of the Civil Rights Movement. This analysis illustrates how these writers displace traditional approaches to social reform through law by insisting on the relationships between law and culture, and culture and social “fictions.” By exploring the slippage between rites and rights, this inquiry interrogates the complicity between cultural-literary practices and legal discourse in the post-Civil Rights era in the U.S.
